ProfeVision Terms and Conditions

Thank you for your interest in ProfeVision ("ProfeVision", "we", "our"), which offers services available at www.profevision.com and on our mobile applications. By using ProfeVision, you agree to these Terms and our Privacy Policy. Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing or using ProfeVision, you agree to comply with these Terms and our Privacy Policy. If you use ProfeVision on behalf of an educational institution or company, make sure you have the authority to accept these Terms on their behalf.

2. Who can use ProfeVision

You must be over 18 years old or have authorization from your parents/guardians and your educational institution.
If you represent an institution, you guarantee that you have permission to accept these Terms on its behalf.

3. Proper use of the service

By using ProfeVision, you commit to:

Provide real and updated information about yourself and your institution.
Not use ProfeVision for illegal, harmful, fraudulent, abusive activities or that violate the rights of others.
Not attempt to access other users' accounts or share your password.
Not use robots, scrapers or other automated means to collect information without permission.
Not overload, damage or interfere with the operation of ProfeVision.
Not impersonate other people or falsify your identity.
Not facilitate or encourage the violation of these Terms.

If you violate any of these rules, we may suspend or cancel your account.

4. Your information and privacy

• When using ProfeVision, you can enter personal and student information.
• You are the owner of that information.
• You give us permission to use, store and process that information only to provide you with the service.
• You can delete your information and your account at any time.

5. Using ProfeVision in educational institutions

If you are a teacher or staff member of an educational institution:

You guarantee that you have authorization to use ProfeVision with your students.

You comply with applicable privacy and data protection laws (such as FERPA in the US or LOPI in other countries).

Nota: If your institution does not want student data to be stored on our servers, you can disable synchronization from your account.

6. Intellectual property

• ProfeVision and its technology are protected by copyright and other laws.
• You may not copy, modify, distribute, sell, decompile or use our technology or brand for other purposes without our permission.
• Using ProfeVision does not give you rights over our intellectual property.

7. Changes to Terms

We may update these Terms to reflect changes in law or our services. We will notify you of important changes. If you continue to use ProfeVision after the changes, it will be considered that you accept them. If you disagree, you can stop using the service and delete your account.

8. Experimental features

Sometimes we test new features that may change or disappear without prior notice. We do not guarantee that they will always work.

9. Limitation of liability

• ProfeVision is offered "as is", without guarantees that it will always be available or error-free.
• We are not responsible for indirect damages, data loss or any damage arising from the use or inability to use ProfeVision.
• Our maximum responsibility to you will not exceed the amount you have paid for the service in the last 12 months or $100 USD, whichever is greater.

10. Security and registration

You must keep your password safe and not share your account.

If you detect unauthorized use of your account, notify us immediately at [email protected].

11. Indemnification

If someone makes a claim against ProfeVision related to your use of the service, you agree to defend us and cover any expense or damage this causes.

12. Account cancellation

You can cancel your account at any time from the "My Account" section or by writing to us at [email protected]. We may also suspend or cancel your account if you violate these Terms.

13. Dispute resolution

If a conflict arises between you and ProfeVision, we will try to resolve it in good faith. If this is not possible, any dispute will be resolved through arbitration in Chicago, Illinois, under the rules of the American Arbitration Association (AAA).

By accepting these Terms, you waive the right to a jury trial or to participate in class action lawsuits.

14. Miscellaneous

If any part of these Terms is invalid, the rest remains in effect.
You may not transfer your account without our permission.
These Terms constitute the complete agreement between you and ProfeVision.
